Reader’s Question:

My car was towed in fron of my apartment because I have an expired license? is it legal in the state of Texas? I live in Dallas.

Laws in the state and other city ordinance set different requirements for towing cars. Towing a vehicle in the state of Texas is not regulated by the Texas Department of Transportation (TxDOT) . This means that they do not determine if a tow is legal or not. According to the TxDOT if a car owner thinks that their car was towed without any probable cause they may dispute the tow through the court system. The hearing can be held or the car owner may consider pursuing the issue through small claims courtsystem.

You may be able to speak to your local police or Department of Motor Vehicle and ask if you local laws states that towing a vehicle because of having expired registration is legalor not in the state of Texas.

You may also read through your lease to check if there is anything concerning any reasons the landlord can have your car towed.
